These General Conditions of Sale determine the rights and obligations of the parties in connection with the online sale of Products offered by AYBAH.

These General Conditions of Sale (GTC) apply to all sales of Products, made through the seller's websites which are an integral part of the Contract between the Buyer and the Seller.

The Seller reserves the right to modify these at any time by publishing a new version on its website. The GCS then applicable are those in force on the date of payment (or the first payment in the event of multiple payments) of the order. These T&Cs can be viewed on the seller's website at the following address: https://aybah.fr/ .

The GCS prevail over any other conditions or any contradictory documents present on the website or social networks or in particular on those applicable in stores and direct sales. 

The Customer declares to have read all of these General Terms and Conditions of Sale, and, where applicable, the Special Terms and Conditions of Sale related to a product or service, and to accept them without restriction or reservation.

The Customer acknowledges that he has received the necessary advice and information to ensure that the offer meets his needs.

The nullity of a contractual clause does not entail the nullity of the GCS. 

Unless proven otherwise, the information recorded by the seller constitutes proof of all transactions.

Price

The prices of our products are indicated in euros, all taxes included (VAT and other taxes applicable on the day of the order), unless otherwise indicated and excluding processing and shipping costs.

In the event of an order to a country other than metropolitan France, you are the importer of the product(s) concerned. Customs duties or other local taxes or import duties or state taxes may be payable. These rights and sums are not the responsibility of the company AYBAH. They will be at your expense and are your sole responsibility, both in terms of declarations and payments to the competent authorities and bodies in your country. We advise you to inquire about these aspects with your local authorities.

All orders, whatever their origin, are payable in euros.

AYBAH reserves the right to modify its prices at any time, but the product will be invoiced on the basis of the price in force at the time of validation of the order and subject to availability.

The products remain the property of the AYBAH company until full payment of the price.

Please note: as soon as you take physical possession of the products ordered, the risk of loss or damage to the products is transferred to you.

presented in French and will be confirmed at the latest when your order is validated.

AYBAH reserves the right not to register a payment, and not to confirm an order for any reason whatsoever, and more particularly in the event of a supply problem, or in the event of difficulty concerning the order received.

Confirmation of your order

Any order appearing on the AYBAH website implies acceptance of these General Conditions. Any order confirmation entails your full acceptance of these general conditions of sale, without exception or reservation.

All the data provided and the recorded confirmation will constitute proof of the transaction.

You declare to have full knowledge of it.

The order confirmation will constitute signature and acceptance of the operations carried out.

A summary of your order information will be sent to you via your order confirmation email address.

Payment

Payment is due in full immediately upon ordering, including for pre-order products and payable in cash using the following payment methods:

- Bank card via the secure payment infrastructure "Stripe"

-Paypal

Cards issued by banks domiciled outside France must be international bank cards (Mastercard or Visa). Secure online payment by credit card is made by our payment provider. The information transmitted is encrypted in the state of the art and cannot be read during transport on the network. Once the payment has been initiated by the Customer, the transaction is immediately debited after verification of the information. In accordance with article L. 132-2 of the Monetary and Financial Code, the commitment to pay given by card is irrevocable. By communicating his banking information during the sale, the Customer authorizes the Seller to debit his card for the amount relating to the price indicated. The Customer confirms that he is the legal holder of the card to be debited and that he is legally entitled to use it. In the event of an error, or the impossibility of debiting the card, the Sale is immediately resolved as of right and the order cancelled.

Withdrawal / Return

EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

In accordance with the provisions of article L.121-21-8 of the Consumer Code, the right of withdrawal does not apply to:

• The supply of goods made to the consumer's specifications or clearly personalized.
• The supply of goods liable to deteriorate or expire rapidly.
• The supply of goods which have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection.
• The supply of goods which, after being delivered and by their nature, are inseparably mixed with other items;
• The supply of digital content not provided on a material medium, the execution of which has begun after the consumer's prior express agreement and express waiver of his right of withdrawal.

As a result, AYBAH creations are specially made to your measurements, so there will be no return or exchange possible.

Availablity

Our products are offered as long as they are visible on the site www.aybah.fr and within the limit of a single order per item. (excluding items in the "basics" category which are not unique pieces)

In case of unavailability of product after placing your order, we will notify you by email. Your order will be automatically canceled and no bank debit will be made.

Delivery

In accordance with Article L 216-1 of the Consumer Code, delivery means the transfer to the consumer of physical possession or control of the goods. 

AYBAH offers its products for sale internationally.

PRODUCTION TIMES ARE 15 TO 21 WORKING DAYS.

The production and delivery times are given for information only. These deadlines may be extended or shortened depending on the activity of the company. As the items are handmade, a large number of orders could lead to an extension of this period. AYBAH can provide the buyer with the tracking number for their package by e-mail. The buyer can also benefit from the follow-up of the evolution of his order in real time via snapchat by sending his snapchat contact details when ordering.

Orders will be delivered to the address you provided when placing your order. 

You must be vigilant and check the address entered before validating your order, because you will be held solely responsible for the consequences resulting from the error of entry on your part and the costs relating thereto, in particular the costs of redirection which will be at your expense and will not be assumed by AYBAH.

Indeed, the delivery will be made to the address indicated by the Customer. For the purposes of proper execution of the order, and in accordance with article 1316-1 of the Civil Code, the Customer undertakes to provide its true identification elements.  

Responsibility

AYBAH cannot be held liable in the event of non-compliance with the legislation of the country where the product is delivered. It is up to you to check with the local authorities the possibilities of importing or using the products or services that you plan to order.

Furthermore, AYBAH cannot be held liable for damage resulting from improper use of the product.

Intellectual property

The products for sale on the aybah.fr website are the property of AYBAH.

The content of the aybah.fr site is the property of AYBAH and is protected by French and international laws relating to intellectual property. Any total or partial reproduction of this content is strictly prohibited and is likely to constitute an offense of counterfeiting. 

Personal data

AYBAH reserves the right to collect personal information and personal data concerning you. They are necessary for the management of your order, as well as the improvement of the services and information that we send you.

They can also be sent to companies that contribute to these relationships, such as those responsible for the execution of services and orders for their management, execution, processing and payment.

This information and data is also kept for security purposes, in order to comply with legal and regulatory obligations.

Archiving Evidence

AYBAH will archive purchase orders and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of article 1348 of the Civil Code.
